Detailed Terms and Conditions of Service
Overview
This document outlines the Terms of Service governing the use of the Furni Fixer website, its sub-domains, and any associated web-based and mobile applications (collectively referred to as our “Website”), as owned and operated by Furni Fixer. These Terms of Service, along with our Privacy Policy and other posted guidelines, collectively constitute the entire and only agreement between you and Furni Fixer. By using our Website, you agree to fully comply with and be bound by these Legal Terms. If you do not accept these Legal Terms, do not access and use our Website. The latest versions of our Legal Terms will be posted on our Website, and you should review all Legal Terms prior to using our Website.
Definations
- "Us" or "We" or "Our": Refers to Furni Fixer, the owner of the Website.
- "Visitor": An individual who merely browses our Website.
- "Member/Client": An individual who has registered to use our Service.
- "Service": The collective functionality and features offered through our Website to our Members.
- "User": A collective identifier referring to either a Visitor or a Member/Client.
- "Content": All text, information, graphics, audio, video, and data offered through our Website.
1. User Accounts, Passwords & Security
1.1 If any of the Services or features offered on or through the Website require an account, you must complete the registration process, providing Furni Fixer with current, complete, and accurate information.
1.2 You are entirely responsible for maintaining the confidentiality of your password and account and for any and all activities that occur under your account. You remain liable for losses incurred by yourself or a third party on your Furni Fixer account.
1.3 Furni Fixer reserves the right to cancel, block, or remove your account at any time without prior notice if any suspicious activities or discrepancies are found under your account.
2. Free Trial
2.1 By submitting a “Free Trial” request, you agree to these Terms of Service, our Privacy Policy, and agree to receive promotional emails and/or phone calls.
2.2 Furni Fixer provides a Free Trial for up to 100 Images to demonstrate our capabilities, expertise, and service level. Eligibility must be proven by reference to a company website and an official email address. Furni Fixer reserves the right to refuse any test work at its sole discretion.
3. Terms of Images & Uploads
3.1 Clients must upload images that meet the specifications and file format guidelines provided by Furni Fixer to obtain the best possible result.
3.2 Orders with more than 300 images that are not of simple complexity will require review and approval before processing. Working on complex images may take extra time, and it is advisable to consult with our Support Team before placing such orders.
3.3 Furni Fixer reviews submissions for inappropriate material and reserves the right to refuse any image for any reason at its sole discretion.
3.4 You represent and warrant that you have the legal authority to enter into this Agreement and that the acceptance of an image by Furni Fixer for editing does not determine your rights to use the image.
3.5 You grant Furni Fixer a non-exclusive, worldwide, transferable, royalty-free, sub-licensable, perpetual, irrevocable license to use the images as necessary for Furni Fixer and its subcontractors to perform the requested services.
3.6 Furni Fixer reserves the right to use any free trial images for promotional purposes and as specimens without the owner’s consent. Clients may be requested to give permission for the use of regular images as samples.
3.7 Quotation requests must be reviewed with the images and required services; the given price will be valid for 7 days. If not accepted within 7 days, a new quote request must be submitted.
3.8 Furni Fixer is protected under copyright and data protection laws. All content and images are protected under these acts and other terms mentioned in the Privacy Policy.
4. Terms of Delivery
4.1 Edited images will be available to respective clients through a secured web URL inside the client portal.
4.2 Images will be delivered and ready for download within the selected turnaround time specified at the time of order placement.
4.3 If we fail to deliver within your chosen turnaround time, we will notify you, and the issue will be resolved through mutual understanding.
4.4 Edited images will be stored on Furni Fixer’s server for 30 days, after which they will be automatically deleted.
4.5 Clients must notify us within 24 hours of downloading their images if they have any complaints or require corrections. Furni Fixer will address and fix any errors determined to be our responsibility.
5. Terms of Payments
5.1 Upfront & Instant Payment: Furni Fixer requires upfront payment for services. Payment can be made through various gateways at the time of placing an order.
5.2 Monthly Account Setup: Corporate clients may set up a monthly account, subject to satisfactory reference checks and at the discretion of Furni Fixer. Such clients must pay the outstanding balance within 30 days to continue using our services.
6. Payment Methods
6.1 We accept payment via PayPal, All Major Cards including MasterCard, Visa, JCB, JCBI, Diners Club, Discover, American Express, China UnionPay, Cartes Bancaires, eftpos Australia, MobilePay, Naver Pay, Nexi Pay, PayCo, PayNow, PostFinance, Revolut Pay, WeChat Pay, CashApp Pay, Apple Pay, Google Pay, Samsung Pay, Link, GrabPay, Clearpay, Alipay, Affirm, Klarna, SEPA, SPEI, iDEAL, giroPay, EPS, BECS, Bacs Direct Debit, Bancontact, ACH Debit, Bank Transfer and more.
6.2 Regular and monthly clients with expenditures exceeding $500.00 per month may use bank wire transfers.
6.3 Furni Fixer reserves the right to change accepted payment methods and their associated details without prior notice.
6.4 Clients should use our Service Portal for payments to ensure correct account information.
6.5 Direct payments must be verified with Furni Fixer to avoid errors due to changes in account details.
7. Refund Policy
7.1 Satisfaction Guarantee: We aim to provide high-quality services and ensure customer satisfaction. If you are not satisfied with our services, you may be eligible for a refund or re-edit, subject to our discretion.
7.2 Refund Requests: Refund requests must be made within 7 days of receiving the final edited images. The request should include a detailed explanation of the dissatisfaction.
7.3 Non-Refundable Services: Some services may be non-refundable, including but not limited to, services that have been substantially completed or custom orders.
8. Limitations of Liability
8.1 Furni Fixer is not liable for any indirect, incidental, or consequential damages arising from the use of our services, including but not limited to loss of data or profits.
8.2 Our liability is limited to the amount paid by the client for the specific service in question.
9. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the jurisdiction in which Furni Fixer operates. Any disputes arising from these Terms will be resolved in the courts of that jurisdiction.
10. Amendments
Furni Fixer reserves the right to amend these Terms of Service at any time. Clients are encouraged to review the Terms periodically to ensure compliance.
